Marketing Rules: The Lines That End Agreements
Clean marketing keeps your agreement — and your book.
CMS codified the marketing lines for the federal Marketplace — and agents get terminated for crossing them. Clean marketing is not caution; it’s survival.
Banned Practices (No Gray Area)
- No cash or cash-equivalent inducements to enroll.
- No false "$0 premium" claims — or any savings/premium promise the enrollment system hasn’t produced.
- No misrepresenting enrollment timelines or deadlines to pressure a signature.
- No enrolling, switching, or attaching yourself to an application without the consumer’s authorization.
Coming: The Standardized Form
Agents, brokers, and web-brokers will be required to use a standardized form for eligibility application review and consumer consent documentation (effective 2028). Build your process around it now: consistent consent language, retained records, documented revocation path.
My Rules On Every Post
- Real me on camera; education first; book the call instead of quoting numbers in comments.
- Never collect SSN, DOB, or bank details in messages — route to a call.
- STOP is honored instantly, everywhere, forever.

I’m Christopher Horne, a licensed broker in FL, TX, AZ, OH, MI, IA, NC, OK, MO, SC, and TN. Agents: text me and compare notes before Open Enrollment. Clients: enroll through my link and I’m still your agent of record — and I review every enrollment the same day.
