The Family Glitch Fix

The 2023 rule change that opened subsidies to millions of families.

For years, a cruel quirk — the "family glitch" — locked millions of families out of Marketplace subsidies: if the employee's self-only coverage was "affordable," the whole family was disqualified from tax credits, even when family coverage cost a fortune. A 2023 federal rule fixed it. If your family was glitched, your options may have changed dramatically.

What changed

Affordability is now measured separately: the employee's self-only cost determines the employee's eligibility, and the family's cost determines the family's eligibility. If covering your spouse and kids through your employer costs more than the affordability threshold percentage of household income, your family members can now get Marketplace tax credits — even while you stay on the employer plan.

The split strategy

The most common winning configuration: employee stays on the employer plan (where self-only coverage is usually cheap and good), while spouse and kids go to the Marketplace with tax credits. This is completely legitimate and increasingly common. I model both configurations — all-family-on-employer vs. split — so you can see the actual dollar difference.

What you need to check

  • Your employer's family premium — the actual payroll deduction for family tier, not the self-only number.
  • Household income — the affordability math runs on total household MAGI.
  • Each family member's needs — networks and formularies may differ between the employer plan and Marketplace options.
  • Kids and CHIP — children may qualify for CHIP separately; check before buying them a Marketplace plan.

Don't assume you're still glitched

Many families who were told "you don't qualify" years ago never rechecked after the fix. If an HR person or a website told you no in 2021, that answer may be wrong now. Recheck every Open Enrollment — the math changes with income, premiums, and the threshold.

Common family-glitch mistakes

  • Never rechecking after 2023 — the fix changed everything; old "you don't qualify" answers are stale.
  • Using the self-only premium — the family's affordability test uses the family premium; that's the whole point of the fix.
  • Forgetting CHIP for kids — children may have a better path than either parent's options.
  • Assuming HR knows — many HR departments still explain the old rule; verify independently.

Pro tip: run the numbers every Open Enrollment — premiums, thresholds, and incomes all move yearly, and the split strategy's advantage changes with them.

The bottom line

The family glitch fix is one of the most consequential coverage expansions in years — and one of the least known. If your family's been priced out of your employer plan, the post-2023 rules may open Marketplace credits you were told didn't exist. Recheck every year; the math moves.
