What Is Guaranteed Issue?
The one-minute explanation of guaranteed issue — no jargon.
Guaranteed Issue: Your right to buy a Marketplace plan regardless of health history — no medical questions, no denials for pre-existing conditions.
In Plain English
Guaranteed issue means the insurer must sell you a plan and can't turn you down, charge you more, or exclude coverage because you're sick, were sick, or might get sick. No health questionnaires, no medical exams, no "pre-existing condition" denials. Every Marketplace plan is guaranteed issue during Open Enrollment and Special Enrollment Periods.
A Real Example
You have diabetes, high blood pressure, and a heart stent from 2022. You apply for a Marketplace plan. The application never asks about any of it, your price is the same as a healthy person your age in your ZIP, and your conditions are covered from day one. That's guaranteed issue working.
Why It Matters When You Shop
This is the protection that makes the Marketplace safe for everyone. But it only applies to ACA-compliant plans — short-term plans, excepted-benefit plans, and health sharing ministries are NOT guaranteed issue and can still ask health questions and deny you.
Watch Out For
Guaranteed issue doesn't mean "buy anytime" — you still need Open Enrollment or a qualifying life event. And it doesn't cap prices: your premium is set by age, location, tobacco use, and plan choice, just not by your health.

Common Questions
Can I buy outside Open Enrollment if I'm sick? Only with a qualifying life event — guaranteed issue means they can't reject you for health reasons, but you still need an enrollment window.
Does guaranteed issue apply to dental or supplemental plans? No — it applies to ACA-compliant major medical plans. Dental, vision, and supplemental products can still underwrite.
What if an agent asks health questions for a Marketplace plan? They shouldn't need to for pricing or eligibility. Health questions on a Marketplace application are limited to what's needed (like tobacco use and household info) — detailed medical underwriting questions are a red flag.
Put It to Work
Guaranteed issue means you can shop without fear — but it also means you should shop strategically. Since health can't affect your price or eligibility, the only variables that matter are the ones you control: income estimation (for subsidies), network fit, drug coverage, and metal tier. Put your energy there instead of worrying about health questions that legally can't be asked.
How I Explain It to Clients
"You cannot be turned down. Period," I tell nervous applicants with serious health histories. "No exams, no questionnaires about your conditions, no higher price for being sick. That's not a sales promise — it's federal law for every Marketplace plan." Watching someone's shoulders drop when they hear that never gets old.
